Common questions

Which New York cases name Kalshi, and where is each one?

Three. KalshiEX LLC v. Williams, 1:25-cv-08846 (S.D.N.Y.), is Kalshi's own suit against the members of the Gaming Commission, decided against Kalshi at the preliminary injunction stage on July 7, 2026 and on appeal as Second Circuit No. 26-1835 (sources 2 and 5). People of the State of New York v. KalshiEX LLC began as a special proceeding in Supreme Court, New York County on July 31, 2026 and is now 1:26-cv-06550 (S.D.N.Y.) after removal (sources 0 and 3). The state-court file itself was marked disposed by an order dated August 3, 2026 (source 6).

What is the state's remand motion asking for?

That the special proceeding be sent back to Supreme Court, New York County, where the Attorney General filed it on July 31, 2026. The motion and its memorandum went in at dockets 16 and 17 on August 7, 2026; Kalshi opposed in 36 pages on August 21; the state replied on August 28, 2026. No decision appears on the docket as of September 2, 2026, and no date is set for one (source 3).

Does the record answer whether a New York resident can use Kalshi?

No, and this page does not answer it either. No court order in the reviewed record directs the exchange to stop serving customers in this state; the Gaming Commission's letter of October 24, 2025 is a regulator demand rather than a court order (source 1); and the permanent injunction requested on July 31, 2026 is relief sought in an undecided proceeding (source 0). No notice from Kalshi naming New York access was located as of September 2, 2026, so the question is open on this record.

What is the CFTC emergency order mentioned in the appeal?

Only a docket entry so far. The Second Circuit docket in No. 26-1835 records a letter filed for Kalshi on August 12, 2026 and describes it as regarding a CFTC emergency order issued 8/11/2026, with a response from the appellees the same day (source 5). No document was obtained from the agency itself, so nothing about the order's existence, scope or effect is stated on this page.
